These Terms & Conditions ("Terms") govern your access to and use of the website located at www.rockinr.com and any related services, content, products, reservations, rentals, and activities offered by Rockin' R River Outfitters ("Rockin' R", "we", "us", or "our") (collectively, the "Services"). Please read these Terms carefully before using the Services or making a purchase.
By accessing or using the Services, creating an account, making a purchase, or booking a reservation, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the Services.
Agreement to These Terms
These Terms constitute a legally binding agreement between you and Rockin' R. They apply to all visitors, users, customers, and guests of the Services. We may also post additional rules, guidelines, or policies in connection with specific products, reservations, or activities, and those are incorporated into these Terms by reference.
Eligibility & Age
To make a purchase or booking through the Services, you must be at least 18 years of age and able to form a legally binding contract. By using the Services, you represent and warrant that you meet these requirements. If you are booking or purchasing on behalf of a minor, you agree to be responsible for that minor and to ensure all applicable rules, safety requirements, and waivers are satisfied. Certain activities may have their own minimum age, height, weight, or supervision requirements.
Your Account
Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated. Notify us immediately if you believe your account has been accessed without authorization. We reserve the right to suspend or terminate accounts that violate these Terms.
Products, Pricing & Availability
We strive to display our products, activities, and pricing accurately, but we do not warrant that descriptions, images, pricing, or other content are complete, current, or error-free. All prices are shown in U.S. dollars and are subject to change without notice. Products and activities are offered subject to availability, and we reserve the right to limit quantities, discontinue offerings, or correct errors, including after an order has been submitted.
In the event of a pricing error, we reserve the right to cancel or refuse any order placed for a product or activity listed at an incorrect price, whether or not the order has been confirmed and your payment method charged. If we cancel an order after your payment method has been charged, we will issue a refund for the amount charged.
Orders & Acceptance
Your submission of an order or booking constitutes an offer to purchase. All orders are subject to our acceptance, and we may accept or decline an order for any lawful reason, including suspected fraud, errors, or unavailability. An order confirmation does not signify our acceptance; acceptance occurs when we fulfill the order or render the service. We reserve the right to refuse service, cancel orders, or limit purchase quantities at our discretion.
Reservations, Rentals & River Activities
Rockin' R offers river-based recreational activities, equipment rentals, shuttle transportation, and related services. These activities take place in a natural outdoor environment and involve inherent risks.
Assumption of Risk & Required Waiver
Tubing, rafting, kayaking, and other river activities are physically demanding and involve inherent and other risks, including but not limited to swift or changing water, currents, submerged objects, slippery surfaces, weather, equipment failure, drowning, serious injury, and death. You voluntarily assume all such risks.
All participants (or a parent/legal guardian for any minor) are required to read and sign a separate liability release and assumption-of-risk waiver before participating. These online Terms do not replace that signed waiver. Participation may be denied without refund if a required waiver is not completed.
You agree to follow all posted rules, safety instructions, and the directions of our staff. You are responsible for assessing your own physical condition, swimming ability, and fitness to participate. Life jackets and other safety equipment must be used as instructed and where required by law. Glass containers, illegal substances, and prohibited items are not permitted, and you must comply with all applicable river, park, and local regulations.
Rented equipment remains the property of Rockin' R. You are responsible for returning rented equipment on time and in the condition received, ordinary wear excepted, and you may be charged for lost, damaged, or unreturned equipment.
Cancellations, Weather & River Conditions
Reservations, rentals, and activities may be subject to specific cancellation, rescheduling, and refund terms disclosed at the time of booking. Because our activities depend on natural conditions, river levels, weather, and safety considerations may require us to modify, delay, relocate, or cancel an activity. Where conditions or events outside our reasonable control prevent an activity from taking place, we will handle cancellations and any refunds or credits in accordance with the terms disclosed at booking and applicable law. We are not responsible for personal expenses (such as travel or lodging) incurred in connection with a cancelled or modified activity.
Shipping & Delivery
For physical merchandise, we will make reasonable efforts to process and ship orders promptly. Shipping timeframes are estimates and not guarantees. Risk of loss and title for purchased products pass to you upon our delivery to the carrier. Shipping options, costs, and estimated delivery times are presented at checkout.
Returns, Refunds & Exchanges
Returns, refunds, and exchanges for merchandise are governed by our Refund Policy, which is incorporated into these Terms by reference. Please review that policy for eligibility, timeframes, and instructions. Refund and cancellation terms for reservations, rentals, and activities are addressed in the "Cancellations, Weather & River Conditions" section above and in the terms disclosed at the time of booking.
Gift Cards, Loyalty & Promotions
Gift cards, loyalty points, referral credits, and promotional codes are subject to any additional terms presented when they are issued or redeemed. Unless otherwise stated or required by law, they have no cash value, are non-transferable, cannot be redeemed for cash, and may be subject to expiration or usage limits. Promotions and discount codes may be modified or discontinued, may not be combined unless stated, and may be voided in cases of suspected fraud or abuse.
User Content & Reviews
You may have the opportunity to submit reviews, comments, photos, or other content ("User Content"). You retain ownership of your User Content, but by submitting it you grant Rockin' R a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, reproduce, display, distribute, and create derivative works of it in connection with operating and promoting the Services. You represent that you own or have the rights to the User Content and that it does not violate any law or third-party rights. We may remove or refuse to post any User Content at our discretion.
Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party right;
- Submit false, misleading, or fraudulent information;
- Interfere with or disrupt the Services, servers, or networks, or attempt to gain unauthorized access to any system or account;
- Introduce viruses, malware, or other harmful code;
- Scrape, harvest, or collect data from the Services without authorization; or
- Use the Services in any manner that could damage, disable, or impair them or interfere with another party's use.
Intellectual Property
The Services and all content on them, including text, graphics, logos, images, and the "Rockin' R" name and marks, are owned by or licensed to Rockin' R and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission.
Third-Party Links & Services
The Services may contain links to or integrate with third-party websites and services (including payment processors and our store platform, Shopify). We do not control and are not responsible for the content, policies, or practices of third parties. Your use of third-party services is subject to their own terms and policies.
Disclaimer of Warranties
To the fullest extent permitted by law, the Services, products, and activities are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, Rockin' R and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed the amount you paid to us for the product, order, or activity giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law. Liability arising from participation in river activities is additionally governed by the separate signed liability release and assumption-of-risk waiver described above.
Indemnification
You agree to indemnify, defend, and hold harmless Rockin' R and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, your violation of any law or third-party right, or any User Content you submit.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Subject to any separate waiver or release you sign, you agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Comal County, Texas, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for operational, legal, or regulatory reasons. We will post the revised Terms on the Site and update the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
General Terms
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and Rockin' R regarding the Services. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
